his small team focused on keeping costs low, quality high, helping community charities instead of buying big ads, and crafting distinctive brews that stood out from mass-produced beers. >> i think the reason why we've been successful is that we've always trusted that people have good taste. rather than trying to dumb things down or do focus groups and try to figure out what does everybody like. >> reporter: the result, even as the recession raged, hindy's place kept going, even as per capita beer consumption plummeted, the brooklyn brewery kept growing. >> well, i think it's just the fundamental fact that people are drinking less beer, but they're drinking more special beers. you know, we offer a whole range, a whole rainbow of flavors of beer. >> reporter: this year he says they will expand their staff of 90 people, open a new shop in stockholm and sell $50 million worth of beer. >> our future is very exciting.

5:00 a.m. in the east. we'll start with a major very many in had the war on terror. sending shockwaves from manhattan to capitol hill to the middle east. osama bin laden's son-in-law captured and in u.s. custody and in just hours, abu ghaith will be in new york. more on how we caught him and the controversy surrounding this court appearance. susan candiotti is here. >> he managed to stay beyond the reach of u.s. authorities all these years just like his famous father in law. now that has finally ended. now the question is how will he be prosecuted and where. some people are challenging that. krr thceci rodgerkr krr. >> reporter: this photo but abu ghaith right up there with osama

bin laden and others. he was out front as a spokesman for the terror organization, appearing in videos and making ominous statements. quote, we have the right to kill 4 million americans with chemical and biological weapons. abu ghaith is believed to have been in osama bin laden's fine astand in tora bora in 2001 before escaping into pakistan. he lived in iran since 2002, mostly under house arrest and is said to have arrived in the turkish capital ankara, early last month. he checked into a luxury hotel and was detain. iran refused to take him back, according to turkish sources. after several weeks in limbo, turkey decided to deport abu ghaith to kuwait. kuwait didn't want him back either. he was transferred to u.s. custody and secretly flown to new york to face trial. some republicans argue that

makes him an enemy combatant who should be tried by a military commission at guantanamo. >> we're putting the administration on notice. we think that sneaking this guy into the country clearly going around the intent of congress when it comes to enemy combatants will be challenged. >> reporter: but the obama administration says it's trying to close gitmo, not add to its prisoners and trying abu ghaith in new york won't jeopardize national security. >> it's a case that would be easy to try in new york. the court in new york has a 100% conviction rate for people accused of al qaeda crimes. >> reporter: abu ghaith stands accused of one count of conspireing to kill americans and allegedly recruiting others to do the same. in court documents, prosecutors quote him saying this after 9/11 -- the storms will not stop, especially the airplane storms. warning americans not to board

any aircraft and not to live in high-rises. he is known as the mouthpiece of al qaeda. so it will be interesting to see when he shows up in court this morning, john, whether he says anything. this is a mere formality. the charges will simply be read to him. but you never know. >> we will be watching. susan candiotti. thank you. >> it's 5:04. all eyes on wall street on the jobs report this morning. the anticipation builds as we couldn't the down to the february jobs report. it's due in about 3 1/2 hours. we're watching and wondering how high the dow can go. will it be an all-time high again? it opens up this morning. >> futures are higher. we had a high again yesterday for the dow jones industrial average. the s&p which is more likely what your stock portfolio and 401(k) is. that's 1% and change away from a

record high. the jobs report for february comes out. this is what we're expecting. expecting 170,000 jobs created in the month. unemployment rate to dip lower to 7.8%. that's still too high. many people say in fact they look at that number on the right-hand of your screen, stocks are at record highs, you've got u.s. household wealth almost returning to peak levels, erasing the losses of the recession. workers haven't felt that. workers haven't necessarily felt that gain. that 7.8% number still a problem. you're seeing these two things happen, stocks powering ahead because companies are doing well. but you're seeing the jobless rate still remain stubbornly high, 170,000 is what we're expecting for the jobs report in 3 1/2 hours. >> stay tune to are that. happening right now, anyone else have an awful trip into work this morning? >> it was disgusting and sloshy and snowy and wet and icky. how about that? >> exactly. the northeast feeling the

effects from this powerful, persistent storm. at least eight states are under winter weather warnings at this hour, bracing for strong winds, rain, snow, general disgustingness, including coastal flooding. lots of it is on its way to new england, new york, long island, could see 3 to 5 edges today. the boston area, could get up to a foot. the heaviest snow will fall in parts of new hampshire. eastern massachusetts, connecticut and rhode island will also get a bunch of snow. >> good gracious. >> samantha moore is in the severe weather center in atlanta. samantha, this just sounds bad. >> yes, it is. as you look here at the water vapor satellite imagery, john, you can see the moisture still embedded. so the center of circulation is starting to move away from land. we still have moisture that will be wrapping in here. of course, we have that surge, so we have problems with the coastal flood threat and the area of low pressure continues to spin and britain that water into the coastline we still have a coastal flood warning, high

tide happening just about now in the new york city area. the areas affected by sandy will likely be affected again today. this morning should be the worst at around 8:00 on the massachusetts coastline. that's what we'll be watching. be very careful if you're going to be out here in the i-59 interstate trying to make your way up the coast. not a good day for travel as you were talking about. the winds out of the north around 20 to 25 miles per hour. so yes, batten down the hatches. it will be a while before this ends. we're thinking tonight. by this evening we should start to see things slack up a bit. >> samantha moore, our thanks to you. >> you're headed to boston or you think you're headed to boston. >> i'd like to be. that's the plan. >> good luck with that. new details on the deadly lion attack. according to the local coroner, 24-year-old dianna hanson died quickly. there was no blood.

the lion escaped from his cage and attacked her in a larger enclosure. she had been working at the cat haven sanctuary since jauron. her love for big cats always had him on edge. >> that always got me, her in the cage. that always scared me. i always had a bad premonition that someday those animals could turn on her. she was absolutely fearless, she was no more afraid of the lions and tigers than she was of the house cat. >> his daughter died doing what she loved and that's helping him cope with this major loss. the funeral for the late venezuelan leader hugo chavez happens in a few hours in caracas. m mahmoud ahmadinejad will be there along with castro. chavez died at the eighth of 58 on tuesday following a battle with cancer.

venezuelan vice president nicholas madaro will be sworn in as president tonight. the body of chavez will lie in state for seven days before it is enbalmed and placed in a gas case forever. >> north korea facing tough new u.n. sanctions this morning in a unanimous vote. the security council passed a measure that will make it difficult for north korea to funnel cash into its nuclear weapons program. china could have used its veto power to block that plan but voted in favor of the sanctions. the vote came hours after pyongyang threatened a preemptive strike against its enemies, including the united states. senator rand paul said he got what he wanted after the marathon filibuster on wednesday. it delayed a vote on brennan.

although he was confirmed eventually. here's what paul had to say about this to cnn's erin burnett. >> i think the response was important. you don't always get a response from the white house when you make an argument but we've been asking for six weeks for this response. the fact that we got it, i feel like it's a victory for us. a new op-ed from former president bill clinton calling for supreme court to overturn the defense of marriage act. he originally signed that into law. the in "the washington post" he writes this, quote, the justices must decide whether it is skin the with the principles of a nation that honors freedom, equality and justice, above all and is, therefore, constitutional. as a president who signed the act into law, i have come to believe that doma is contrary to those principles and in fact incompatible with our constitution. this as a recent cbs news poll

shows 54% of americans think same-sex marriage should be legal. 39% oppose it. scientists say another asteroid, this one the size of a football field will whiz past earth this weekend. this is happening just days after a different, much smaller rock made a closer fly-by. the new asteroid is 330 feet wide and will miss earth by 306,000 miles. this is roughly the size of this meteor which exploded last month over russia. that fireball you remember detonated before astronomers knew it existed. more than 1,600 people were injured, mostly by flying glass. it could soon be law to require the head of every household in one georgia town to own a firearm and ammunition. the city council of nelson, georgia, population 1,300 voting unanimously this week to pass what they're calling the family protection act. >> most everybody that lives here that are original residents

alexander. randi kaye takes us inside the courtroom for a second day of tough questions. >> reporter: if she hadn't been cut in a web of lies would jodi arias ever come clean about killing travis alexander? jurors wanted to know. >> would you decide to tell the truth if you never got arrested? >> i honestly don't know the answer to that question. >> reporter: why, they ask, did it take her so long to tell the truth? it wasn't until two years after the killing that she claimed self-defense. first she said she wasn't there. then changed her story to two masked intruders. all her lying seems to have hit a nerve with the jury. >> after all the lies you have told, why should we believe you now? >> lying isn't typically something i just do. but the lies that i've told in this case are -- can be tied

directly back to either protecting travis' reputation -- >> reporter: what about arias's experience with guns? >> never fired a gun but i was relatively familiar with them. >> reporter: and even if she wasn't sure she shot alexander as she says, why not call 911 for help? in case. >> when i sort of came out of the fog i realized oh, crap, something bad had happened. and i was scared to call any authority at that point. >> reporter: right after she killed alexander arias drove to utah to visit another guy. jury wanted to know how she could kiss another man just hours after shooting and stabbing her exboyfriend to death. she explained, she had no choice. she had to show up to avoid suspicion. and like every other day in court, the testimony eventually turned to the couple's sex life. the jury has listened to recordings of their phone sex, read their dirty text messages, even looked at naked pictures they took the day of the

killing. but they wanted to know more. if he had abused arias in the past, as she claims, why did she go along with alexander's sexual fantasies? >> if you were scared of what travis was capable of doing, why would you ever let him tie you up? >> when that occurred, he was in a very good mood and, again, they were -- they were loose enough to wiggle out of. so i wasn't stuck there. >> reporter: on the day she killed him -- >> was travis tied up at any point on june 4, 2008? >> no. >> reporter: there were also more questions about arias' memory lapses. >> you remember dropping the knife and screaming but you don't remember taking the gun or rope with you. >> it goes blank after that. i don't remember putting the gun in the car. i don't remember putting the rope in the car. >> how can you say that you don't have memory issues when you can't remember how you stabbed him so many times and slashed his throat?

>> well, i think that i have a good memory and june 4th is an anomaly for me. i don't think i have memory issues that are any different from another average person. >> reporter: one thing arias may never forget are these pictures of travis alexander dead. >> would you agree that you came away from the june 4 incident rather unscathed while travis suffered a gunshot and multiple stab wounds? you've only had a bump on your head, a because on your head, cuts or scrapes on your ankles and a possible shoulder injury. >> as far as making comparison of physical injuries, him versus mine, yes, i would have to say that's a relatively accurate assessment. >> reporter: randi kaye, cnn, phoenix, arizona. >> some tough, tough questions from jurors. >> it's been fascinating to watch. >> 19 minutes after the hour right now. i want to bring you up to speed on the top news today.

welcome back to "early start," everyone. we are minding your business this morning and the dow hit another record on thursday. and there could be more coming. futures are pointing to more gains today. the s&p 500 also nearing its record high, just 20 points away. which if you do the math which is 1.3%. >> could we see more momentum. >> we could. we have momentum in japan. looks like they have data showing they're coming out of a recession. that's got japanese stocks moving higher. we have this monthly jobs report due at 8:30 a.m. eastern. economists are predicting 170,000 jobs added to the payrolls in february. the unemployment rate expected to tick down to 7.8%. i'll be looking for the big snowstorm in the east in february may have affected this.

how the sequester might be at play here. there's a lot of moving parts that i'll be interested to see the health of the labor market, especially we've been seeing the record highs in stocks. workers are not feeling the benefits that companies and investors are feeling that's a real lynn interesting trend. all but one of the nation's largest banks by the way could survive another deep recession. this is according to the federal reserve's latest stress test. of the 18 banks the fed tested only ally financial showed big enough losses. ally is the former finance arm of general motors. citigroup was the top performer among the six largest banking institution s. have you heard about the facebook face lift? >> we've been talking about it. >> the news feed update is supposed to reduce clutter. in addition to the news feed you'll see new feeds, one for all friends which shows everything they're sharing. one for photos, music and one

osama bin laden's son-in-law in u.s. custody and just hours from being arraigned in federal court here in new york city. suleiman abu ghaith charged with conspireing to kill americans. he faces life in prison and it's been quite a journey for the former al qaeda spokesman. in the past month, abu garage went from house arrest in iran in ankara, turkey. turkey decided to send him back to his native kuwait through jordan. that's where the cia nabbed him. more from cnn's joe johns. >> reporter: suleiman abu ghaith is charged in an indictment unsealed on thursday with conspiracy to kill americans from at least may 2001 to 2002. including the september 11th attacks. he was a face of al qaeda terror, a known propagandaist for the organization and son-in-law of osama bin laden. he appeared in scary video recordings in 2001 and 2002. >> translator: woman of the

[ muted ], this is all for jihad. >> reporter: more is known about what he has said than what he has done. >> this is a guy who was a high school teacher in kuwait and shortly before 9/11 popped up in afghanistan and started speaking in videotapes, made a number of threatening statements against the united states in the post-9/11 time period and then has disappeared from site. >> reporter: the fact that the suspect has been brought to new york sends a message that the department of justice has not abandoned its sometimes controversial attemptso try certain international terror suspects, especially those associated with the 9/11 attacks. in civilian court as opposed to military tribunals. >> although they defer to the reality of bringing these individuals to trial in the military commissions, they have not given up. the cause of the federal courts. >> reporter: the question has always been whether military

tribunals are better suited for people deemed to be enemies of the united states as opposed to treating them to all the rights afforded to civilian defendants in american courts. a point that was quickly raised by republicans in the senate. >> gitmo, there's no substitute for it that congress will agree upon, that it is the right place to put an enemy combatant for interrogation and when at all possible trial. >> reporter: the justice department said it examined the nature of abu ghaith's conduct and determined the best place to bring charges against him was in civilian court. it's unclear whether he's provided any useful information to u.s. authorities. joe johns, cnn, washington. 34 minutes after the hour right now. a lot of people wondering this, will we see yet another record high for the dow today? it closed at a new high yesterday, of 14,329 when trading ended. the s&p 500 is closing on its own all-time high, just about

1.3% away. we're also awaiting a big report from the labor department in three hours. it issues the first jobs report since the deep across-the-board federal spending cuts began. a cnn money survey predicts about 170,000 job gain. they are expecting the unemployment rate to dip slightly to 7.8%. we will bring you those numbers live at 8:30 a.m. eastern time. >> he will not engage in what he calls chess beating over iran's nuclear program but does plan to issue a clear and direct challenge to tehran during his upcoming middle east trip. he made these comments at a white house meeting with jewish american leaders. this was thursday night. the president said he will still work toward a diplomatic resolution with iran but repeated that no options are off the table, including military ones. police in elizabeth, new jersey, launching an investigation into this youtube video that appears to show one police officer punching a woman in the face. this happened outside a nightclub.

the woman appears to possibly grab the officer before he winds up. the mayor of elizabeth calls the action unacceptable. the officer involved has not been identified and we understand is still on active duty. michigan democrat carl levin is calling it quits after six terms in the senate. he won't run for re-election in 2014. the long-time armed services committee said it was an extremely difficult decision for him. he says he'll be better able to serve his constituents for the next two years without the distraction of a re-election campaign. >> been there since 1979. 36 minutes after the hour. should a 7-year-old ever have to worry about going on a diet? an australian mom was horrified when she found her daughter's handwritten diet and exercise list in the girls bedroom. >> so tragic. while the foods she list may seem like reasonable choices, the spelling lets you know how young this little girl is. on her diet list, d-i-y-e-t, the

arbitrary cuts -- >> this doesn't seem to be a wave of this. >> kids will get hurt. >> is this a case of shall we say chicken little? >> the sky is falling! >> it didn't fall unless you count the snowstorm that threatened washington this week and probably shut down government for a day. just because the sky did not fall it doesn't mean it didn't grow a little darker. and these crickets could soon turn to groans, with no congressional white house cooperation cuts are coming, big ones and soon. notices are out to thousands and thousands of defense industry employees telling them they'll have an unpaid day off every week starting in april. the federal aviation administration says it will have to start closing air towers at some small and medium-sized airports starting in april and the white house says, no more public tours as of tomorrow. of course, in a display of mutual assured maturity, some members of congress have threatened the president no more

tours, no more golf. >> they'll be able to get their tour of the white house and all it will cost is one or two golf trips less. >> one cut that has already taken effect, the president's poll numbers. he's down 4 points since february. maybe one reason he has tempered his dire prophecies some. >> we will get through this. this is not going to be a apocalypse i think as some people have said. >> reporter: one reason perhaps he suddenly has a voracious bipartisan appetite, inviting key republicans to lunch and dinner the last couple of days. so maybe the skies will brighten and these will turn to shouts of joy. >> the good news is they are talking. just because no one has felt any changes yet, really, they could be coming as soon as april. a lot of the furlough notices have gone out. people will have to start missing days of work. people who don't want to miss those days, starting fairly

soon. >> i was talking to somebody who was supposed to appear on a panel. if her office she's plan for the furloughs. she can't do travel right now. things are changing, we just haven't seen it yet. >> not a sudden thing. >> hopefully they'll solve it before april. right? we'll keep our fengers crossed. here's christine romans with our top stories. >> in just over four hours, osama bin laden's son-in-law is scheduled to appear in federal court in new york. suleiman abu ghaith facing aarraignment on charges he conspired to kill americans. the former al qaeda spokesman and the wife of osama bin laden's daughter fatima was captured in jordan last week and faces a maximum penalty of life in prison. police in wheat ridge, colorado asking for help searching to are a missing woman. she was last heard from on february 21st. her home was searched is and there's no evidence of a crime scene.

meyers and her two vehicles are both missing. several florida beaches open after thousands of sharks prompted lifeguards to close them. the schools of sharks are migrating up the coast as the water starts to warm for the summer. something that happens every year but, boy, those pictures give you pause. the makers of bumblebee and chicken of the sea are recalling, voluntarily. a loose seal on the cans could cause spoil or contamination. two words, above all to remember this weekend. spring forward. >> oh, no! >> yep. daylight savings time arrives at 2:00 a.m. sunday morning meaning we lose one hour's sleep. >> that is the bad news. especially on this shift, that's terrible news. >> what's the good news? >> you'll get an extra hour of daylight. >> yes. >> in the afternoon and evening which is really nice. >> forget you. >> it's a sign that winter is

the snow swirling around. how the u.s. got their hands on him and some are challenging, how and where he should be prosecuted. this photo puts abu ghaith squarely in al qaeda's inner circle. he's to the left of his father-in-law, osama bin laden, along with top lieutenants muhammed atef and al zawahiri. he appears in videos and makes ominous statements. quote, we have the right to kill four million americans with chemical and biological weapons. abu ghaith is believed to have been at osama bin laden's final stand in 2001 before escaping into pakistan. he lived in iran since 2002, mostly under house arrest and is said to have arrived in the turkish capital of ankara last

month traveling on a forged saudi passport. he checked into a hotel and was detained. iran refused him. after several weeks in limbo turkey decided to deport abu ghaith to kuwait, the country of his birth but kuwait didn't want him back either. he was eventually transferred to u.s. custody and flown to new york to face trial. some republicans argue that makes h him an enemy combatant who should be tried by a military commission at guantanamo. >> we are putting the administration on notice. we think sneaking this guy into the country clearly going around the intent of congress when it comes to enemy combatants will be challenged. >> reporter: the obama administration says it is trying to close gitmo, not add to the prisoners and that trying abu ghaith in new york won't jeopardize national security. >> it's the sort of case it would be easy to try in new

york. new york federal court has 100% conviction rate for al qaeda crimes. >> reporter: his indictment unsealed abu ghaith is accused of one count of conspiring to kill americans and recruiting others to do the same. in court documents, prosecutors quote him saying this after 911. the storms will not stop, especially the airplane storms, warning americans not to board any aircraft and not to live in high rises. abu ghaith has been called the mouthpiece of bin laden. one with fbi official compares him to a consiglieri from the mob. >> thank you. >> three minutes after the hour. the other big story this morning, it's possible the dow may end the week with yet another record high. stock futures now are pointing higher as we head to the opening bell. the anticipation is building for

the federal jobs report due out in two and a half hours. christine romans is here to tell us about it. >> when you look at the major stock market averages they have had a good year. in fact, just over the past six, eight weeks it's been -- you would be happy if this was a year return for you. take a look at the dow jones industrial average. it is up huge. this is year to date. you can see here -- i can't read down there. it's had a nice run. >> i can't help you either. >> go to cnn money and take a look to see what it is. the dow is 30 big blue chip stocks. the s&p 500 is more represent of your 401(k). the jobs report today will likely decide whether you see a high again in stocks for today. this is what we expect from the jobs report in two and a half hours. in february, 170,000 jobs created and an unemployment rate ticking down. a lot of discussion about record highs in stocks and still such a

high unemployment rate. part of the reason is companies are giving back money in dividends, sar buybacks. the stock market is doing well. the job market is slower. there is a disconnect between them. i will have more later in the hour. as we get closer to the 8:30 number i will look for signs of forced spending cuts i jobs, especially government jobs. we'll see if it factored in. there was also a snowstorm last month. i promise in two and a half hours it could be an interesting number for us to gest. >> stay with us all morning for breaking economic news. christine will cover all of it. >> happening now the storm that just will not go away. the northeast feeling the powerful storm lingering on the east coast for two days. now it's ruining commutes all over new england. eight states are under warnings bracing for strong winds, rain and we are worried about the

coastal flooding and lots of snow on the way. new york and long island could see three to five inches today while in boston you could get up to a foot of snow. the heaviest snow will fall in new hampshire, eastern massachusetts, connecticut and much of rhode island will also see heavy snowfall. >> it's just gross out there. >> it is. sorry. >> that's a meteorology term this morning. new details about the young female intern killed by a lion at a california animal sanctuary. according to the coroner diana hanson died quickly from a broken neck. there was no blood drawn when the 350-pound african lion escaped from the cage and attacked her in a larger enclosure. she was working at the cat haven sanctuary for two months. his father said she was never happy but said her love for big cats made him nervous. >> that always a got me, her in the cage. it always scared me. i had a bad premonition some day

the special tomb is under construction and will be dedicated to what they call the populist revolution of hugo chavez. north korea facing tough new united nations sanctions designed to make it difficult to put cash into the nuclear program. it was passed unanimously yesterday. china could have used its power to block the plan, but voted in favor of the sanctions. this hours after pyongyang threatened a nuclear strike against enemies including the united states. >> rand paul is declaring victory after a his 13-hour filibuster which delayed a vote on john brennan's confirmation as cia a director. he was confirmed. attorney general eric holder confirmed president obama doesn't have the authority to use a drone to kill an american not engaged in combat on u.s. soil. here's what paul had to say about it to erin burnett. >> i think the response was

important. you don't always get a response from the white house when you make an argument. we have been asking for six weeks from the response. the fact that we got it, i feel like it's a victory for us. >> former president bill clinton is calling on the supreme court to overturn the defense of marriage act which is a law that he actually signed as president. he writes in the washington post, the justices must decide whether it is consistent with the principles of a nation that honors freedom, equality, and justice above all and is therefore constitutional. as the president who signed the act into law i have come to believe doma is contrary to those principles and, in fact, incombatable with the constitution. some 54% of americans think same-sex marriage should be legal. 39% oppose it. the high court will hear arguments in three weeks. another close encounter of the rocky kind. another asteroid will whiz past

start," everyone. while the obama administration works to tighten the gun control laws a small georgia community is taking a completely opposite approach. council members in nelson, georgia -- population 1300 -- are passing a measure to require the head of every household in the city to own a gun. and the ammunition to go with it. shannon travis joins us now live from washington. good morning. >> good morning, john. nelson, georgia, is 50 miles outside of atlanta. this potential law, an ordinance proposal now called the family protection act. we went and looked it up. the purpose of it, officials say, is to better protect those 1,300 people in the city. there are a few exemptions if the law is passed. if you are a gun felon, probably a good idea to be exempt from being required to own a gun. if you are a pauper -- a word in the proposal -- meaning you are

poor. mental and physical disability or anybody opposed to owning a gun. if there are exemptions to the law and if it is passed it won't actually be enforced then why do it at all, john? well, the people say it is to send a message to washington about the effort, the push to tighten the nation's gun control laws. take a listen. >> our government at the moment want to take as much away from us as they can. >> we want to take this countywide and statewide to other counties and states. >> with all of the attention on nelson you can i pammen residents are reacting for and against the idea. take a listen. >> most everybody that lives here that are original residents here have always had firearms. >> what's the point?

horsemeat. >> first the meatballs and now the hot dogs. >> ikea is testing meat in all markets. they suspended sales of the famous swedish meatballs after there were traces of horse dna in the product. former vice president al gore facing a lawsuit over the sale of current tv to aljazeera. john terenzio said he came up with the plan to distribute an american version. he said gore first opposed the idea and had a change of heart and went ahead with the $500 million sale. terenzio wants to be compensated for his role. starbucks isn't worried about the ban on large drinks in new york city. they said they won't immediately comply for two reasons. they are legally trying to overturn the regulation and claims most of the products aren't even subject to the ban. new york city mayor michael bloomberg instituted the ban of sugared drinks above 18 ounces

great roll for the year. you would take this return for a whole year. instead you have had it just for this part -- you could have another record today depending on the jobs report. we expect it to show 170,000 jobs reported and maybe 7.8% unemployment. one of the things people are talking about is this disconnect. you are seeing all of the signs that wealth is coming back. the stock market is on a roll. household net worth has come back. government figures show you are almost back to where you were in 2007. that's impressive. the blue bunch of bars there is the recession. slowly climbing back. most americans, especially looking for a job, hey, wait, my household net worth isn't back and my job prospects haven't come back. we are looking at how productivity has been so good for american companies, but it hasn't resulted in higher wages for american workers. when you look at the gap that shows how american workers have been getting squeezed this is a

post war chart. the top line is productivity. the companies are getting more out of you. the bottom line is your wages. look at the past 15, 20 years for wages. sideways. we are with talking about records in wealth creation, records in the stock market. it's's justified that workers aren't feeling it. i will jump into it with the sequester, spending cuts, whether we are seeing underlying strength. >> that was a long flat line. what do we need to know about our money? >> you are seeing results here. mortgage rates are low. freddie mac says a 30-year fixed rate mortgage is now 3.52%, just up a bit from last week. that's an average. some people with good credit pay get lower rates. if your credit isn't that good you will get a higher rate. that's still low. when i say you're not feeling it, if you are a homeowner or going out to buy a home or an

former al qaeda spokesman. in the past month he went from house arrest in iran to turkey where he was released. turkey sent him back to his native kuwait through jordan. that's where the cia nabbed him. susan candiotti is live in manhattan at the federal courthouse. this is quite a story. it is and abu ghaith has been cooling his heels in new york. before the court hearing at 10:00 eastern time in the courthouse over my shoulder. this over a lot of questions about the involvement the cia and fbi had from getting him from turkey to jordan on to the u.s. this photo puts abu ghaith in al qaeda's inner circle.

he's to the left of his father-in-law, osama bin laden, along with top lieutenants muhammed atef and al zawahiri. he appears in videos and makes ominous statements. quote, we have the right to kill four million americans with chemical and biological weapons. abu ghaith is believed to have been at osama bin laden's final stand in 2001 before escaping into pakistan. he lived in iran since 2002, mostly under house arrest and is said to have arrived in the turkish capital of ankara last month traveling on a forged saudi passport. he checked into a hotel and was detained. iran refused him. after several weeks in limbo turkey decided to deport abu ghaith to kuwait, the country of his birth but kuwait didn't want him back either. he was eventually transferred to

u.s. custody and flown to new york to face trial. some republicans argue that makes him an enemy combatant who should be tried by a military commission at guantanamo. >> we are putting the administration on notice. we think sneaking this guy into the country, clearly going around the intent of congress when it comes to enemy combatants will be challenged. >> reporter: the obama administration says it is trying to close gitmo, not add to the prisoners and that trying abu ghaith in new york won't jeopardize national security. >> it's the sort of case it would be easy to try in new york. new york federal court has 100% conviction rate for al qaeda crimes. >> reporter: his indictment unsealed abu ghaith is accused of one count of conspiring to kill americans and recruiting
